Terms & Conditions
Agreement
In ticking the 'Terms and Conditions' tickbox you agree to be bound by these terms and conditions and you the hirer (Hirer) of the boat the “Moonlight Express” (Boat) agree to make payment in accordance with these terms and conditions on the basis of the hire period (Hire Period) that you nominate in completing this electronic request to hire the Boat (Electronic Request) at the hire rate (Hire Rate) that is specified.
Payment
- The charter price, being the Hire Rate multiplied by the number of hours of the Hire Period (Charter Price), includes hire of the Boat, skipper and deckhand (Crew) and is inclusive of GST.
- Upon completing this electronic request form and receiving an email from proprietors of the Boat, within five working days, the Hirer will pay a non-refundable booking fee of $1,000 (Booking Fee), within five working days, to the proprietors of the Boat.
- Payment of the balance of the Charter Price and any catering is to be paid to the proprietors of the Boat at least three working days prior to the day of the Hire Period, with non-payment within that timeframe allowing the proprietors of the Boat to, at their absolute discretion, cancel the hire of the Boat to the Hirer and retain the Booking Fee.
- The skipper of the Boat is solely responsible for the safe navigation of the Boat and is the sole arbiter as to whether it is appropriate or prudent to make way at any given time, having regard to the weather and water conditions prevailing at the time.
- The Hirers can make reasonable request of the skipper, subject to them being lawful, appropriate and safe. However, the skipper will not do anything that jeopardizes the safety of the vessel or its passengers.
Damage to Persons or Property
- The Hirer is solely responsible for any injury suffered by Hirer or the Hirer’s guests whilst on the Boat, which are not the direct result of negligence on the part of the Crew.
- The Hirer must abide by the requirements of being a good host and ensure that alcohol is served in a responsible manner. The Hirer indemnifies the proprietors of the Boat in respect of any claim against the proprietors or any member of the Crew for any injury suffered by any person on the Boat as a result of the Hirer or any of the Hirer’s guest’s intoxication whether by alcohol or otherwise.
- All items, including but not limited to food and beverages, brought on board the Boat by the Hirer or the Hirer’s guests must be removed from the Boat on the day that the Hire Period expires. Any items left on board the Boat become the property of the proprietors of the Boat to be disposed of as they deem fit.
- Damage to the boat, its equipment, or fit out caused by the Hirer or any of the Hirer’s guests will be charged out at replacement or repair cost to the Hirer. Extraordinary cleaning costs will be an additional charge.
- Only suitable footwear may be worn on the Boat, with the proprietors or Crew of the Boat having the absolute discretion to require the Hirer or any of the Hirer’s guests to remove, else be denied entry to the Boat, inappropriate footwear, including, but not limited to, high heels, abrasive footwear, or footwear which leaves marks on the Boat’s unsealed wooden floors.
